01Who we are

Fontaine Noire is a marketing consultancy based in Bordeaux, France, and is the data controller responsible for the personal data described in this policy. For any privacy request or question, you can reach us at contact@fontainenoire.com.

02What data we collect

We collect only what we need, in three situations:

• When you contact us — the details you submit through our contact form or by email: your name, and (where you provide them) your business name, email address, phone number, the service you are interested in, and the content of your message.
• When you browse the Website — with your consent, analytics and advertising technologies collect technical and usage data such as your device and browser type, approximate location, pages viewed, and how you interact with the site. We also use a privacy-friendly, cookieless analytics tool that measures aggregate traffic without identifying you.
• When you become a client — the information needed to deliver and administer our services, as set out in the applicable proposal or agreement.

We do not intentionally collect special categories of data (such as health or political opinions), and the Website is not directed at children.

03How we use your data & our legal bases

We use personal data for the following purposes, each with a legal basis under the GDPR:

• To respond to your enquiry and discuss a possible engagement — on the basis of steps taken at your request prior to a contract, and our legitimate interest in replying to you.
• To provide our services to clients — on the basis of performance of our contract with you.
• To measure and improve the Website and understand how visitors use it (analytics) — on the basis of your consent.
• To measure and improve our advertising, including Google Ads conversion measurement and remarketing — on the basis of your consent.
• To keep the Website secure and functioning — on the basis of our legitimate interest, and for strictly necessary functionality.
• To comply with legal obligations where they apply to us.

04Cookies, analytics & advertising

We use cookies and similar technologies to measure traffic and campaign performance. Analytics and advertising cookies are set only after you consent: by default every non-essential category is denied, and Google Consent Mode enforces that default until you make a choice in our cookie banner. Strictly necessary technologies needed for the site to work do not require consent.

The main technologies we use are:

• Google Analytics 4 — audience and behaviour measurement (loads only with your analytics consent).
• Google Ads — conversion measurement and remarketing (loads only with your advertising consent); ad-identifier redaction is enabled.
• Google Tag Manager — to manage the above tags, subject to the same consent signals.
• Vercel Web Analytics — privacy-friendly, cookieless aggregate traffic measurement that does not identify individual visitors.

You can change or withdraw your choice at any time through your cookie preferences. Withdrawing consent does not affect the lawfulness of processing carried out before you withdrew it.

05Who we share your data with

We do not sell your personal data. We share it only with service providers who process it on our behalf, under appropriate contractual safeguards, including:

• Google (Google Ireland Ltd / Google LLC) — for the contact form back-end (Google Apps Script, Google Sheets, and Gmail notifications), analytics, advertising, tag management, and the web fonts used on the Website.
• Vercel — website hosting and cookieless web analytics.

We may also disclose data where required by law, to enforce our terms, or to protect our rights, property, or safety.

06International transfers

Some of our providers (such as Google and Vercel) may process data outside the European Economic Area, including in the United States. Where that happens, the transfer is protected by appropriate safeguards — such as the EU Standard Contractual Clauses and/or the provider's certification under the EU–U.S. Data Privacy Framework.

07How long we keep it

We keep enquiry details only as long as needed to respond and, if we do not go on to work together, for a reasonable period afterwards (up to 24 months) before deleting them. Client data is retained for the duration of the engagement and for any period required to meet our legal, accounting, and tax obligations. Analytics and advertising data are retained according to the providers' settings and standard retention periods.

08Your rights

Under the GDPR, you have the right to:

• access the personal data we hold about you;
• have inaccurate or incomplete data corrected;
• have your data erased in certain circumstances;
• restrict or object to certain processing, including profiling for advertising;
• receive your data in a portable format;
• withdraw consent at any time, without affecting prior processing.

To exercise any of these rights, email contact@fontainenoire.com. We will respond within the time limits set by law. If you believe we have not handled your data properly, you have the right to lodge a complaint with the French supervisory authority, the CNIL (www.cnil.fr), or your local data protection authority.

09How we protect your data

We apply appropriate technical and organisational measures to protect personal data against unauthorised access, loss, or misuse, and we limit access to those who need it to provide our services. No method of transmission or storage is completely secure, but we work to protect your data and to address any incident promptly.

10Changes to this policy

We may update this Privacy Policy from time to time. The current version is always available on this page, with the “last updated” date shown above. Material changes affecting how we use your data will be reflected here.
